Media coverage irretrievably damaged Talwars' image: Supreme Court

NEW DELHI: The Supreme Court on Wednesday lashed out at the media for going overboard and "irretrievably" damaging the image of the Talwar family in the sensational Aarushi murder case.

 

"Irretrievable damage has been done to the couple who lost their only child. This is unthinkable in a democracy," a three-judge bench of Justices B N Aggrawal, V S Sirpurkar and G S Singhvi observed, while hearing the multi-crore UP provident fund scam allegedly involving some judges.

 

The apex court lamented the media has converted itself into a "super investigation bureau" for reporting cases.

 

It maintained the judiciary would, however, not be influenced by such reporting.

 

"Media must know that it does not affect judicial minds," the bench observed during the five-hour-long arguments in the provident fund scandal.

 

The Ghaziabad Bar Association, besides two NGOs, have filed petitions before the apex court seeking a probe by an independent investigating agency including registration of FIRs against the judges for allegedly syphoning off provident funds belonging to Class IV employees.

 

"If some high profile person is involved in some case you (media) will carry the show the whole day," the bench observed.

 

The apex court gave vent to its anger on the media when senior counsel and constitutional expert Anil Divan cited certain media reports in the scandal to buttress his arguments.

Arushi case: Judicial custody of Krishna, Raj Kumar extended


A special Central Bureau of Investigation (CBI) court on Friday extended by 13 days the judicial custody of Krishna and Raj Kumar Sharma, accused of murdering Noida teenager Arushi Talwar and the family's domestic help Hemraj.

The court fixed the next date of hearing on August 21.

Intense drama prevailed in the courtroom when the policemen accompanying the three accused handcuffed Raj Kumar and Vijay Manual while taking them back from the witness box.

Arushi was found murdered in her parents' upscale Jal Vayu Vihar apartment in Noida May 16. The Noida police immediately named Hemraj as the prime suspect but retracted when his body was found on the roof of the apartment the next day.

The police arrested Arushi's father Rajesh Talwar May 23, saying he killed his daughter in a fit of rage because he objected to her closeness with domestic help Hemraj. Talwar was released July 11 after 50 days of imprisonment, with the CBI saying there was no evidence to link him to the crime.

The CBI took over the case June 1 after a public hue and cry over the shoddy manner in which the Noida police had conducted the investigations.

Looks like the CBI is not going to let up on these guys even if they have to manufacture evidence.  What a terrible way to coduct business. I guess Bollywood doesn't really make up such stuff in their movies after all.

I saw a report on Aajtak.. that looks so called scientific evidence CBI was saying are not working.. CBI clearly does not have any evidence against the 3 accuses.. they hv to submit the chargesheet eithin 15 days.. thier hand is empty...

looks like murder mystery of 2008 again became a BLIND CASE..

New Delhi, Sept 04: In what has come as a shocker to the CBI, the Ghaziabad Court on Thursday granted bail to Vijay Mandal, one of the co-accused in the Aarushi-Hemraj murder case, citing lack of sufficient evidence.

The bail has been granted against a bail bond of RS 25,000.

The CBI had opposed the bail plea of Vijay Mandal, Krishna and Raj Kumar, the three suspects in the Aarushi-Hemraj murder case arguing that they might abscond if they get bail.

CBI said that it is still investigating the case while claiming that it has evidence to prove the trio's involvement. However, it said that those evidence would be revealed only after the narco and brain mapping reports come.

This disclosure is significant, as the CBI has to file the chargesheet within 90 days, i.e. by 10th September. But, it seems they still do not have enough evidence against the three accused.

As evidence in the murder case continues to haunt CBI, reports suggest that the agency may not be able to file its chargesheet by the September 10. The CBI had earlier claimed to have cracked the case on the basis of scientific tests of the accused but they are yet to get some corroborative evidence. CBI has even failed to trace the mobile phone of Arushi and the murder weapon.

Aarushi was found dead in her bedroom on May 16. The UP police initially blamed domestic help Hemraj but later backed away after his body was found a day later on the terrace of the flat.

Later, the police arrested Aarushi's father Rajesh Talwar. The case was then handed over to the CBI, which did not find evidence against Talwar, leading to his release in July.

CBI won't file chargesheet in Arushi-Hemraj murders


The CBI on Tuesday said that it would not be filing any chargesheet in the sensational Arushi murder case "for the time being" as investigation into the blind murder case was incomplete.

The decision of CBI will pave the way for release of Krishna, who was arrested in the case, on bail on expiry of the stipulated 90-day period for filing chargesheet, which expires on September 13.

Addressing a press conference, Deputy Inspector General of CBI Neeraja Gotru said the investigations were incomplete and the agency would not be filing chargesheet.

Gotru also said that the weapon of offence and the mobile phones of the deceased - Arushi Talwar and Hemraj - were yet to be recovered and further linkages proved.

"A Letters Rogatory has been sent to Nepal for seeking assistance in locating some witnesses and mobile phones of the deceased," she said.

The DIG also announced that the CBI will give Rs 1 lakh anyone giving further clues in the case, leading to recovery of weapon of offence and mobile phones.

Referring to the filing of chargesheet against Krishna, arrested on June 13, Raj Kumar, arrested on June 26, and Vijay Mandal, who was picked up on July 11, Gotru said CBI will "file report under Section 173 CrPC (chargesheet) only on the conclusion of the investigation.

"The full facts of the case will be presented before the court," she said, adding that the investigations into the case would continue as of now.

Gotru said Section 167 of the CrPC gives right to every person in custody to be released on bail if no chargesheet is filed against him within 90 days of the custody.

"If and when the bail application of the accused person in custody comes up in court, the full facts of the case will be presented before the court in a truthful, legal and professional manner by the CBI," she said.

Among the three, Mandal was released on bail by the designated court last week.Edited by uknaik99 - 15 years ago

Aarushi case: Talwars disappointed at CBI's failure

New Delhi, Sept 09: The family of Aarushi, one of the victims in the Noida double murder case, today said they were "disappointed" over CBI's inability to file a chargesheet in the sensational case and fear over the prospect of the two accused coming out on bail.

"We were pretty hopeful that the CBI would be able to file a chargesheet on time and we would get to know what happened that day," Aarushi's father Rajesh Talwar said.

Talwar, who was initially arrested by the Noida police as an accused in the murder of his teenaged daughter and domestic help Hemraj before being given a clean chit by the CBI, said he still had faith in the investigating agency. "We still have faith in the CBI and I think they will help us and Aarushi to get some justice in the case," he said.

Talwar's wife Nupur was, however, more vocal about her disappointment over CBI's decision to delay filing a chargesheet that may enable both Krishna and Rajkumar in custody to get bail.

"It did give us a lot of hope. CBI is a premier probe agency and I had lot of faith that they would be able to nab the culprits but from today's statement, it appears that they have not reached far," Nupur told media.

She said it was important for the family to know what happened that day.

"The only hope I have now is that CBI would be able to tell us what happened and we would start picking up pieces of our lives," Nupur said.

Earlier speaking to media, Vandana Talwar, Aarushi's aunt, said the family was disappointed over the development.

"We were really hoping but this news has come as an disappointment. We thought that at least one chapter of the case would close but now we have realised that it is still open," Vandana said.
