The CBI has filed a case against Dr Rajesh Talwar and one unidentified person for the murder of Arushi and servant Hemraj.

Experts feel that the dentist who is an asthma patient could not have murdered the two all on his own. Besides, three glasses of liquor were found in Hemraj's room, indicating that two others were there with him on the night he was murdered.

His mattress had depression at three separate places, showing that three persons sat on it.
Even the Noida police had said that more arrests were likely in the case, asserting that they had not given Nupur Talwar a clean chit. But the big question is who helped Talwar in brutally killing the two?

The possible suspects are:

Nupur Talwar


Arushi was murdered inside her 2000 sq ft house. The police say it was almost impossible for Nupur Talwar not to have heard anything at the time when her daughter was being murdered.

They argue that Nupur could not have remained oblivious to the two murders committed within a short distance of her bedroom. Nupur might be trying to conceal the truth behind the motive of the killings.

The police are yet to find any evidence, apart from circumstantial evidence, against Nupur. Nupur said that she would not have sat quietly on that fateful night knowing that her daughter was being  murdered in another room.


Vikas

Vikas has been accused of destruction of evidence. A blood soaked mattress from Arushi's room was taken to the terrace by Umesh, driver of the Talwars.

During an interview to a TV channel Umesh said that he was ordered to take the mattress to the terrace by Vikas which was lying unattended for more than 24 hours after Arushi was murdered.

The blood stained mattress could have been of great help to the forensic team and the police. So why did Vikas instruct the driver to take the mattress to the terrace?

There is no motive that one can ascribe to his involvement in the murder. The police claimed to have interrogated him. But now he is also untraceable.


Anita Durani

Though she may not be directly involved in the murder itself, but Anita's name has cropped up quite prominently. The police have already concluded that it was the extra-marital affair between Anita and Arushi's dad Rajesh that led to the murder of the teen.

However,  she categorically rejected such claims. The police also claim that she was in constant touch with Rajesh in the days leading to the murder. They say that Rajesh was upset as Arushi knew about her father's affair.

Alleging a frame up by the police, Anita says that she was not even once interrogated or detained by the police.

UP Police treated Rajesh Talwar very badly: Lawyer

NOIDA: The lawyer of Rajesh Talwar, accused of murdering his daughter Aarushi and the family's domestic help Hemraj, has alleged that the dentist was treated "very badly" by the Noida police.

 

Pinaki Mishra, the lawyer, said Talwar's family met Rajesh on Sunday after about seven to eight days and "he is in a very bad shape".

 

Rajesh Talwar was arrested by the Noida police a week after the murder of his 14-year-old daughter and domestic servant.

 

"They (police) have made him sit out for 48 hours without being allowed to sleep. He has been subjected to intense emotional and psychological trauma and terror," Mishra said.

 

He also expressed hope that CBI would take corrective steps immediately and shift him to a hospital.

 

Meanwhile, the CBI, which took charge of the Noida double murder case on Sunday from the Uttar Pradesh Police, is likely to file an application in the court on Monday seeking custody of accused Rajesh Talwar.

 

The CBI team had on Sunday registered a first information report in the matter.

Chief minister Mayawati's decision to hand over the Noida double murder case to CBI must have come as a huge relief to the UP police, which for the last 15 days had been working more on scripting new theories than making any headway in the probe.

 

The last of the attempts by UP police to support its "honour killing" theory was to leak excerpts of Aarushi's e-mails to her parents. In these e-mails, she appears to be confessing to something she did, which was apparently not to the liking of her parents and for which she was seeking forgiveness.

 

The excerpts fitted in perfectly with the police's earlier "objectionable but not compromising" aspersion on her character. More damagingly, it led to public conjecture that something was so gravely wrong with her deed that she preferred an e-mail rather than telling it to her parents.

 

By clinging to the apologetic e-mail to fan the "we told you so" canard about the girl, the police has laid bare its insensitivity and lack of understanding about the psychology of a teenager.

 

Between 1882-1885, when Mohandas K Gandhi was of Aarushi's age, he had written a somewhat identical letter to his father making a clean breast of how he sold off a piece of his brother's solid gold armlet to clear a debt.

 

A teenaged Mohandas had indulged in eating meat, a sacrilege in the Gandhi family. He had stolen money from servants to meet the expenses of his inquisitive smoking needs.

 

He had also visited a prostitute, got tongue-tied and frigid before her, only to be thrown out with an avalanche of abuses. The persistent lying to parents to cover up all these, which even in today's society are considered sins, gave intense moral pangs to Mohandas. Clearing a debt by selling a piece of armlet made the guilt unbearable for him. Despite living under the same roof, he decided to write a letter to father Kaba Gandhi. There was no e-mail, so he personally handed it over.

 

"I was trembling as I handed the confession to may father," Gandhi wrote in his autobiography 'My Experiments With Truth'.

 

"He read it through, and pearl-drops trickled down his cheeks, wetting the paper. For a moment, he closed his eyes in thought and then tore it up." Mohandas too cried, vowed never to repeat it and stayed true to his promise throughout his life.

 

No one expects the cops to read Gandhi. But they are surely expected to consult psychologists to understand the guilt pangs of a teenager and legal experts before brazenly violating the right to privacy of a dead girl by making public details of e-mails.

 

It could have submitted the e-mails to court in sealed cover if these were any evidence linked to the crime. It is for this reason that one needs to stress over and over again on the Supreme Court judgment in Prakash Singh's case directing separation of investigation and law and order duties, each a specialist police job.

 

In this 2006 judgment, the SC had quoted a letter written by the Union home minister on April 3, 1997, to all state governments imploring them to understand the "great national importance" in insulating the police force from "growing tendency of partisan or political interference in the discharge of its lawful functions of prevention and control of crime including investigation of cases and maintenance of public order". Almost all police reform commissions as well as the Law Commission had, in the past, suggested separation of investigation and law and order wings of police.

 

The latest committee, headed by former attorney general Soli J Sorabjee, in its report suggested establishment of an autonomous Bureau of Criminal Investigation (BCI) in each state. It is imperative in crime investigation, especially homicide cases, that the police has sufficient forensic skills to lift all possible evidence from the crime scene at the earliest before TV crew and others run over the place.

 

A TOI reader and student in forensic science wrote, "Why is the police not taking help of forensic scientists to help collect vital evidence in every crime? Why should these scientists be confined to the laboratories alone? Why do the the police not discuss with forensic psychologists to understand the motive behind the crime, rather than float theories?" These are certainly relevant questions for the states as well as the Centre to consider and proceed in a direction of equipping the police force to investigate a crime methodically and scientifically.

Wonder what the late Aarushi would have to say were she able to read everything that is being written since her passing. The fallout after her untimely, painful and cruel death will hopefully inspire some lawmakers to introduce new legislation that will take away the "abusive and absolute dictatorial power" the police seem to enjoy all over India.

 

I hope that any new legislation also clearly addresses what is "compromising and objectionable" with regard to the behavior of the police. Currently the Indian Police think that they are above the law, and exempt from displaying any decency towards anyone.

India tops world murder count

NEW DELHI: India has earned the dubious distinction of being the country where maximum number of murders takes place in the world, three times more than its neighbour Pakistan and double the figures in United States.

 

There were more than 50 lakh incidents of crime reported in 2007-08 which included murder, rape and drug offences, a government report said. There were 32,719 incidents of murder recorded in India, whereas there were 16,692 in the US and 9,631 in Pakistan, the report compiled by National Crime Records Bureau and released by the Union Home Ministry, said.

 

India was followed by South Africa which registered 30,960 incidents of murders. Austria had recorded just 148 murders, whereas Israel registered 177 such incidents.

 

However, the rate (per lakh population) of murder and other crimes in India was much less compared to other countries. The murder and rape rate in India is three and four (per lakh population) respectively whereas South Africa recorded occurrence rates in the two categories as 65.27 and 115.8 respectively.

 

"Most of the murders take place due to passion, sudden provocation, crime related and family disputes,'' Delhi police spokesman ACP Rajan Bhagat said. Delhi has recorded an increase of 1.08% in murders in 2007 compared to 2006.

 

The number of rape cases was maximum in the US which recorded 93,934 such assaults followed by South Africa 54,926 and India 18,359.

 

The data was compiled in 22 countries which included Australia, Argentina, Austria, Bulgaria, Japan, Canada, England and Wales, Germany, Malaysia, New Zealand, Thailand and Sri Lanka besides others. In India, there were 44,159 incidents of sexual offence, 2,70,861 cases of serious assault and 22,814 robbery and violent theft-related incidents, the report said.

 

The maximum number of robbery related cases were reported in Japan which had registered 17,25,072 such counts.

 

The US topped the crime list with 2,31,13,708 total crime related incidents, whereas India registered overall 50,26,337 criminal cases.

That headline is soooo misleading, am not surprised though because most of English media in India indulge in this most of the times...lead by TOI.

First of all, India's population is almost 4 times that of US and 7 times that of Pakistan. Correct way to measure crimes is by measuring it against the population of respective nations.

I just made this quick table to put things in correct perspective....

CBI examines Talwar house, questions Anita Durrani

A five-member Central Bureau of Investigation team on Monday minutely inspected the home of the Talwars, including the terrace, for clues to the murder of teenaged Aarushi Talwar and their domestic help more than a fortnight ago.

 

The CBI team, which also brought along a worker equipped with a stone cutter, cut away a block of the terrace wall that had the imprint of a blood stained palm. A forensic expert inspected the terrace, the three bedrooms, the staircase and the doors of the flat.

 

The CBI team reached the Jal Vayu Vihar home of the Talwars at 1 pm and spent three hours poring over the place, collecting samples of blood and other tell-tale evidences. 

 

A city court on Monday sent Rajesh Talwar, father of Aarushi, to CBI custody for a day. The CBI, which on Sunday took over the probe into the May 16 Noida double murders, sought custody of Aarushi's dentist father for seven days, but the court in Noida agreed to only one day, and specified that Talwar's lawyer must be present during his interrogation.

 

Another CBI team, comprising four members, inspected Anita Durrani's residence at Noida. The team inspected her house minutely and questioned Anita, a family friend of Rajesh Talwar. Nothing was known of the questioning of Anita, with whom Rajesh Talwar was alleged to have a relationship.

 

The Chief Judicial Magistrate of Noida court, AK Singh, while granting a day's custody to the CBI, directed the investigation agency to present Talwar before the court at or before 4 pm on Tuesday.

 

Meanwhile, Talwar's lawyer requested the court to grant him bail. The prosecution said it could not be considered as the court had granted a day's custody to the CBI.

 

The Noida police had accused Talwar of murdering Aarushi and the family's domestic help Hemraj in a double murder that has shocked the nation. The body of 14-year-old Aarushi was found on May 16, with her throat slit. The police initially suspected Hemraj to be the murderer, but his body was found a day later on the terrace of the house, killed in the same manner.

 

The case has been transferred to the CBI following widespread condemnation of of the way Utar Pradesh police handled the investigations initially.

60% urban Indians feel unsafe at home

Days after the Aarushi Talwar and Neeraj Grover murders (the chief suspect in the Aarushi case is the father, while a 'close' woman friend and her alleged boyfriend killed Neeraj), a shocking new verdict has been delivered: people in our cities feel that the spectre of crime has moved closer home.

 

Three out of five feel "more unsafe and threatened" after the recent spate of murders in our cities, while 74% blame urban lifestyles for urban crime. "We shouldn't separate ourselves from the Grovers and Talwars. This could happen to us," says Ameeta Mulla Wattal, principal, Springdales School, Pusa Road.

 

Family members and friends could well be perpetrators, say two out of every five respondents (41%) surveyed. Two-thirds of the respondents say they do not trust the country's police, and feel they are not competent enough to track down perpetrators. More than half the respondents (54 per cent) say lack of communication and relationships breaking down — at home, at the workplace and among friends — is leading to more "urban lifestyle-driven" crimes.

 

"There are intense rivalries, frustrations and anger, there are no mechanisms in society to mollify those emotions and there are no personal restraints," points out sociologist Imtiaz Ahmed.

 

Worryingly, the state of affairs seems to be taking a toll on urban mindsets: 53% respondents say they will "take revenge" on their partners if they (the partners) betrayed them.

Dr Rajesh Talwar, father of murdered teen Arushi, remained the prime suspect in the case with the Central Bureau of Investigation (CBI) following in the footsteps of the Noida police in its line of investigation.

The CBI is focussing on trying to get the murder weapon by interrogating Talwar during the one day remand it got from the court. The Noida police had remained unsuccessful in finding the weapon despite having had Talwar in their custody for three days. The CBI are just as convinced as the Noida cops so far as the likely role of Talwar in the case is concerned. A CBI team also interrogated Anita Durani, left untouched by the Noida cops despite their assertion that the colleague of Dr Talwar had an affair with him which could likely have led to the crime.

Sources say that the manner in which the CBI is using forensic team makes it clear that the agency has a clear idea of the complicity of Arushi's near and dear ones in the horrific murder.

For instance, the forensic experts scanned not only Arushi's room for blood stains but also searched through the bedroom of the teen's parents to find out whether the killer was in that room after murdering the schoolgirl and her servant Hemraj.

The CBI would take finger prints of the suspects in the case and match them with the 20 sets of finger prints that were lifted from the Sector 25, house of Talwars.

Short of raising fingers at Noida police, the agency however would look at whether the evidence related to the case were deliberately destroyed during the course of investigation.

The CBI interrogated prime accused and Arushi's dentist father Dr Rajesh Talwar at the headquarters but without making any headway. It also questioned Dr Anita Durani, who according to UP police had an extra marital relationship with Talwar.

Though the Noida police dragged Durani's name into the controversy it never cared to question her. "As per the statement of Dr Nupur Talwar (Arushi's mother), Durani family was among the first few people to know about Arushi's murder. We need to corroborate Nupur's statement with the people she has mentioned," said an officer.

Forensic experts reached the spot early in the day and searched the house again to lift finger prints and other important details. The entire block was put out of bound for the journalists. Apron clad experts were seen observing a 'hand print' on a wall on the terrace. By the evening, armed with a drilling machine the experts cut the piece of the wall to carry forward their investigation.

However, CBI officials admitted it was too late to collect any credible forensic evidence due to rain and meddling by neighbours, curious onlookers and journalists. According to sources, the agency did not get much from Dr Nupur Talwar as she repeated what she had already told the Noida police about the sequence of events.

However, the sleuths point out that it found glaring discrepancies in the statement of the maid Bharti and Dr Talwar's driver Vikas. Bharti was the first person who reached the house in the morning and opened the door from outside. The sleuths also interrogated Vikas, the clinic manager of Talwars. The agency plans to counter both Rajesh and Nupur to find more details.

The agency is also checking the statement of UP IG Gurdarshan Singh that Arushi was close to Hemraj and used to discuss his father's relationship with Anita.

The hard disk of Arushi's computer and Dr Talwar's laptop was also handed over to CBI as part of case property. It will try to retrieve all the deleted data from the computers.

What was Dr Rajesh Talwar wearing on the fateful night when his daughter Arushi Talwar was murdered in her bed? Contradictory replies given to this question by the dentist, his wife Nupur Talwar and their driver Umesh have strengthened the CBI's suspicion that the family is hiding something about the crime

CBI investigators who took Dr Talwar to his Noida residence for questioning on Tuesday morning along with his wife Nupur  were left baffled with their conflicting replies over what Rajesh was wearing on the night of the murder.

Sources said while Rajesh claimed that he was wearing a t-shirt and shorts, Nupur said that he was wearing a kurta-pyjama.

Factual error

The investigators are now wondering whether the discrepancy is actually a pointer to the fact that Rajesh changed his clothes sometime during the night.

While Nupur said he wore a kurta pyjama at night, the dentist's assertion that he was wearing a red t-shirt and shorts is upheld by videos which show him in this attire at the time Arushi's body was being brought out of the Talwars' Noida home for post-mortem by the police.

Rajesh's driver Umesh while talking to MiD DAY also confirmed that the dentist was wearing a red t-shirt in the morning when he reached the flat on finding out about Arushi's murder.

Interestingly, Talwar also told the CBI that on the night of the murder, he had taken an insulin injection to control his increased blood sugar level. However, Nupur said she had no such recollection of her husband taking the shot that night.

Mysterious role

CBI sources said though Dr Talwar may not be the prime accused in the case, the family's role in the entire murder mystery cannot be ruled out.

Such conflicting statements from the husband and wife are further strengthening these doubts.

A senior CBI official said, "Such statements show that the family is hiding something important or had differences related to something very serious in nature.

We want to question them together only to point out those differences and bring out the actual facts."

Arushi's parents were questioned in front of Rajesh's brother Dinesh Talwar who was among the first to reach the house after the murder came to light.

CBI officials also tried to re-create the scene of the murder as explained by the Talwar family and a similar exercise will be repeated again today.

The CBI officials are also surprised that the Talwar family after demanding a CBI probe is now refusing to co-operate with the agency sleuths. "Dr Talwar is not co-operating and is giving conflicting statements. Both he and Nupur are trying to hide important facts related to the case," said the officer. 

The defence counsels who also had demanded a CBI probe yesterday contested the agency's application for extending the custody of the doctor.

On track

CBI Director Vijay Shanker says that the investigation is going in the right direction. "The investigation is being carried out in a diligent way and it is a long-term process," he said.

Talking to MiD DAY, Vijay Shankar refused to comment on the investigation carried out by the Noida police and said, "I don't want to say anything over the procedure adopted by the Noida police but our investigation is going on in the right direction," he said. 

The CBI has been granted an extended remand of two days for Dr Talwar on  grounds that he is not co-operating and is a major link in the entire murder mystery.
