I never made any Islamic post on any show and even i was not watching this show in the beginning but my friends especially Manal (.FlawlessSarun.) asked
me to watch the show because she was worried due to the concept of the
show. As i was not having the link to verify so i asked *Shifali* for the link who sent me the link.The post is a bit delayed due to the shortage of time. I am forced to make this post due to the concept of the Show Qabool Hai on Zee TV's official Site which is given below (I have just copied and pasted from their official site). Though they didn't use the word of Helala but the show concept is dealing with it.Ayaan's temporary marriage to Zoya gets dissolved and Zoya finds out that Ayaan was responsible for it. ... Ayaan realizes that the only way he can win back Zoya is with the help of Asad.
I know and understand that they still didn't show but they have given it officially on zee tv's site that they are going to show it. AS ITS NOT ALLOWED IN ISLAM AND PEOPLE WILL BE TAKING A WRONG IMAGE DUE TO LACK OF KNOWLEDGE ABOUT IT THAT'S WHY I AM POSTING IT HERE WITH A REQUEST NOT TO DISCUSS SUCH RELIGIOUS ISSUE WITHOUT PROPER KNOWLEDGE OF ITWhat is Helala
a man divorces his wife for the third time, she is not permissible for
him to marry until she has married another man as mentioned in Quran (Al-Baqarah 2: 230). The consummation of second marriage is compulsory as mention in many Ahadith (Bukhari, Volume 7, Book 63, Number 186-187; Abu Dawood, Book 12, Number 2302)
Prophet Muhammad Peace be Upon him said "Of all the lawful acts the most detestable to Allah is divorce." (Sunan Abu-Dawood Hadith 2173)
Islam strongly encourages the believers to protect their marriage under all circumstances as mention in above hadith that this is the most detestable lawful act to Allah. Islam also recognizes that humans are not like animals who can be compelled to live with each other even if they do not wish to do so; thus Islam has permitted and allowed the believing couple who find it absolutely impossible to live with each other within the bounds of marriage, as an absolute and last resort, to separate by divorce, if they sincerely wish to do so.
women remain in waiting for three periods, and it is not lawful for
them to conceal what Allah has created in their wombs if they believe in
Allah and the Last Day. And their husbands have more right to take them
back in this [period] if they want reconciliation. And due to the wives
is similar to what is expected of them, according to what is
reasonable. But the men have a degree over them [in responsibility and
authority]. And Allah is Exalted in Might and Wise. (Al-Baqarah 2: 228).
this verse 2:228 was revealed, the ruling that made the divorce thrice
and specified when the husband is ineligible to take his divorced wife
back, had not been revealed yet. (The divorce is twice, after that,
either you retain her on reasonable terms or release her with
kindness). Previously, the man used to divorce his wife and then take
her back even if he had divorced her a hundred separate times. Ibn Abu
Hatim reported that Urwah said that a man said to his wife, "I will
neither divorce you nor take you back.'' She said, "How?'' He said, "I
will divorce you and when your term of Iddah (waiting time for the next
marriage) nears its end, I will take you back.'' She went to Allah's
Messenger and told him what happened. Allah abrogated this and said:
(The divorce is twice). (Tafsir Ibn e KAthir).Divorce
is twice. Then, either keep [her] in an acceptable manner or release
[her] with good treatment. And it is not lawful for you to take anything
of what you have given them unless both fear that they will not be able
to keep [within] the limits of Allah. But if you fear that they will
not keep [within] the limits of Allah, then there is no blame upon
either of them concerning that by which she ransoms herself. These are
the limits of Allah, so do not transgress them. And whoever transgresses
the limits of Allah - it is those who are the wrongdoers. (Al-Baqarah 2: 229).This
honorable verse abrogated the previous practice in the beginning of
Islam, when the man had the right to take back his divorced wife even if
he had divorced her a hundred times, as long as she was still in her
Iddah (waiting period). This situation was harmful for the wife, and
this is why Allah made the divorce thrice, where the husband is allowed
to take back his wife after the first and the second divorce (as long as
she is still in her Iddah. The divorce without intervals of a specific
period is prohibited (Al-Tirmidhi 3292 as the interval allows a man and
woman to return each other during that waiting period). The divorce
becomes irrevocable after the third divorce, as Allah said in above
verse the divorce is twice, after that, either you retain her on
reasonable terms or release her with kindness. (Tafsir Ibn e KAthir)And
if he has divorced her [for the third time], then she is not lawful to
him afterward until [after] she marries a husband other than him. And if
the latter husband divorces her [or dies], there is no blame upon the
woman and her former husband for returning to each other if they think
that they can keep [within] the limits of Allah. These are the limits of
Allah, which He makes clear to a people who know. (Al-Baqarah 2: 230)
So the reason of such restriction was to stop the practice and insult which was going on with the women at that time. Another reason was to make people conscious that if they divorce the woman for the final 3rd time she will not be there for them anymore so they should not make fun of her and her feelings and if they really love and respect that woman they must be nice to her.
Even it is order in the following verse that if anyone wants to separate woman, he should be nice and release her nicely without harassing or harming her. Allah warns such people to fear Allah, who knows everything.
when you divorce women and they have [nearly] fulfilled their term,
either retain them according to acceptable terms or release them
according to acceptable terms, and do not keep them, intending harm, to
transgress [against them]. And whoever does that has certainly wronged
himself. And do not take the verses of Allah in jest. And remember the
favor of Allah upon you and what has been revealed to you of the Book
and wisdom by which He instructs you. And fear Allah and know that Allah
is Knowing of all things. (Al-Baqarah 2: 231)
Allah has allowed woman to return back to her ex-husband in case of death or the divorce from the second husband in the following verse.
when you divorce women and they have fulfilled their term, do not
prevent them from remarrying their [former] husbands if they agree among
themselves on an acceptable basis. That is instructed to whoever of you
believes in Allah and the Last Day. That is better for you and purer,
and Allah knows and you know not. (Al-Baqarah 2: 232)
But it doesn't mean that a husband and his ex (divorced) wife should ask someone for Helala after breaking their marriage and after crossing the limits of allowed divorce. The way Halala concept is being shown in the show "Qabool Hai" mentioned on Zee TV's official site
is not Islamic and Qur'an and Ahadith (Sayings of
Prophet Mohammad Peace be Upon Him, the 2nd major source of commands for
Muslims) intensely detest it. Helala is allowed only
- if by chance the second husband die
Nikah with intention of Helala is not allowed as Prophet Muhammad Peace be Upon Him said about halala;
- if a woman gets divorce from the next husband by chance due to some misunderstanding or problem.
"Allaah has cursed the muhallil and the muhallal lahu." ( Abu Dawood 2076; Tirmidhi, Nasa'i) (The
muhallilis the one who marries a woman and divorces her so that she can
return to her first husband, and the muhallallahu is the first
Marriage with the intention of helala is totally haram (not allowed) in Islam as it also involves another divorce and marriage consummation.
Muhammad Peace be Upon Him also said: 'If any woman asks her husband
for divorce without some strong reason, the odour of Paradise will be
forbidden to her.' (Abu-Dawood 2218).
As Allah Subhanahu Wa Ta'allah cursed the people doing Helalah (Abu Dawood 2076) and women is not allowed to get divorce from the husband without any strong justifying reason. ' (Abu-Dawood 2218) so Helalah is Heram (Illegal in Islam).
Contract Marriages were allowed in the beginning but then got banned by Prophet Mohammad Peace be upon Him.
bin Abi Talib (May Allah be pleased with him) reported that Allah's
Messenger (May peace be upon Him) prohibited on the Day of Khaibar the
contracting of temporary marriage with women and the eating of the flesh
of domestic asses. (Muslim Book 008, Number 3263, 3265, 3267 further supporting ahadith 3264, 3255, 3257, 3259, 3226)
4lions better to change the concept of the show and must not discuss a very serious issue involving religion without having proper knowledge of it, as whatever
the show is presenting is being considered taught by islam according to the
audience's perception, just due to their claim of "Msulim Social Drama".
