After Ajay Devgn's appeal, Yash Raj Films to be investigated

Ajay Devgn appealed to the tribunal after his petition against YRF was rejected by the Competition Committee on November 5, 2012.
Fireworks began early this Diwali. The Yash Raj Films produced Jab Tak Hai Jaan, starring Shah Rukh Khan, and Ajay Devgn's Son Of Sardaar box office clash was given an unexpected twist with Ajay Devgn Films accusing YRF of using their dominant position to keep Son Of Sardaar out of theatres. The Competition Apellate Tribunal has now decided that YRF should be investigated to determine if this is true.

Ajay Devgn appealed to the tribunal after his petition against YRF was rejected by the Competition Committee on November 5, 2012. A statement from Ajay Devgn Films said: The Competition Appellate Tribunal has seen merit in our case and has issued notice for enquiring into the anti competitive activities of YRF about the tie in arrangement to block our movie Son of Sardaar on the day of Diwali.

In a legal notice, Ajay Devgn Films had accused Yash Raj Films of creating a monopoly among exhibitors and using it's influence to keep Son Of Sardaar out of theatres in favour of Jab Tak Hai Jaan. YRF had defended themselves saying that the release strategy for Jab Tak Hai Jaan had been closed when their last film released on August 15 - Ek Tha Tiger, starring Salman Khan.

The production house maintained that many of the 1407 theatres that had screened Ek Tha Tiger would not be showing Jab Tak Hai Jaan. This meant 586 theatres would be free to show Son Of Sardaar. The tribunal-ordered inquiry will determine if this is correct based on evidence after both films release on November 13.

Ajay Devgn told NDTV, "Industry people have started reacting. There are people who are suffering. I hope it benefits the industry. I hope the outcome is fair."

He also told agencies earlier that his fight was not with Shah Rukh Khan, star of the rival film.

Shah Rukh Khan, on his part, said that this was a legal matter not involving him. However, he also said, "I find it amusing. This has been decided since a year. They (makers of Son of Sardaar) must have also known, so what is the problem then? If you have delayed, then it's not our fault. I just find it wrong."

Jab Tak Hai Jaan is the last film directed by Yash Chopra, founder of Yash Raj Films, who died on October 21. It co-stars Katrina Kaif and Anushka Sharma. Son Of Sardaar co-stars Sonakshi Sinha.

Yes please investigation karo...jara pata toh chale ke YRF apna saara profit kaun se swiss bank mein daalne waala hai...I know for sure that Ajay Devgan is going to give all his profit to RED CROSS...Thumbs Up...after all YRF is doing business...and ADF is doing CHARITY...Thumbs Up

COMPAT refuses to stay 'Jab Tak Hai Jaan' screening

The Competition Appellate Tribunal today refused to stay the screening of 'Jab Tak Hai Jaan' produced by Yash Raj Films but issued notices to the production house on Ajay Devgn's plea that alleged abuse of dominant position. Ajay Devgn Films (ADF) had moved the tribunal after the Competition Commission rejected the plea against Yash Raj Films for alleged abuse of dominant positions.

Both Ajay Devgn's 'Son of Sardar' and 'Jab Tak Hai Jaan' are slated to release on November 13 and advanced bookings have already started. The tribunal said huge economic interests are at stake for both the parties' films and there could be irreparable loss, if the release is stayed. "We desist from passing any order," it said and noted that "it would not be proper on our part to freeze the agreements" between Yash Raj Films and the single screen film exhibitors.

However, the tribunal has issued notices to Yash Raj Films (YRF) along with its distributor entities, following ADF's appeal. The tribunal bench headed by chairman Justice VS Sirpurkar also said that "it was not expressing any opinion (about the matter) at this stage".

On the second day of hearing today, film maker Prakash Jha, a close friend of Ajay Devgn, was present and was assisting ADF's lawyers during the proceedings. Fair trade regulator Competition Commission had rejected Devgn's complaint against Yash Raj Films, saying that there are no violations of competition norms in the case. ADF had moved the Commission alleging that Yash Raj Films was using its dominant position to ask exhibitors to dedicate more screens to its own upcoming release, Shahrukh Khan-starer 'Jab Tak Hai Jaan', affecting Devgn's film 'Son of Sardaar'.

The Commission had said Devgn did not place on record any data related to market share or economic strength to show how the YRF was in a dominant position in the relevant market. Last Friday, the Delhi High Court had asked the CCI to "expeditiously" decide on Ajay Devgn Films' complaint that 'Son of Sardaar' was allegedly not getting enough single-screen theatres as Yash Raj Films allegedly has used its dominant position for better exhibition of 'Jab Tak Hai Jaan'.

As per the Commission, the grievance of Ajay Devgn Films arose due to fear that it would not get enough theatres for 'Son of Sardaar' because of the agreement of single screen theatres with Yash Raj Films at the time of releasing 'Ek Tha Tiger'.

One good thing that is coming out of all this is, Ajay is exposing the monopolistic ways thats going on in the industry... 
Frankly SOS is not a make or break movie for Ajay. But yes, there are other small film-makers who's movies have been crushed by the big production houses because of monopoly. They did not have the power/clout to take on the big guys. 

Ajay's stand in this will benefit the other small filmmakers... Ajay could have just shut up on the whole issue or he could have moved his release date... And what would have come out of it... YRF and its dubious ways would have been pushed under the carpet and again they would still continue their monopoly and crush small unknown films along the way... Hopefully after this episode the smaller filmakers too will be vocal abt it and make their voice heard. 
Kudos to Ajay for sticking to his conviction and fighting it out... Thumbs Up

the same EROS was monopolystic last year whn Ra one released.
nobody talked about monopoly when ETT released with 3300 screens !!! LOL
and Ajay aint doing anything great... no big movies hav clashed in past few years so its a first time so how cn one accuse of monopoly !!!Silly
