The Central Bureau of Investigation (CBI)'s closure report, containing the findings of its probe in the murder of Class 9 student Aarushi Talwar (13) and domestic help Hemraj Banjade (45) in May 2008, says it couldn't establish a motive for the crime. Neither could it link the crime to the girl's PARENTS
The agency's closure report says, "…there are a number of critical and serious gaps in the circumstances which make it difficult to string together the sequence of events and motive behind the gruesome murder".The report, though, says that a "number of circumstances… indicate the involvement of the parents in the crime and the cover-up".
The report says:
The scene of the crime was "heavily dressed" or cleaned up, which could only have been done by the parents.
Aarushi's body was found covered with a white sheet, her pyjama and undergarment had been changed.
The key to her room was with Nupur, who could not explain how and why it was lying in the lobby.
Aarushi's bed linen was undisturbed despite the use of force in the crime; there was evidence of post-mortem cleaning of her private parts.
Surgical cuts on the necks of both victims was the work of a small surgical tool/khukri and by surgically-trained persons.
Rajesh did not identify Hemraj's decomposed body when it was found a day later.
The key circumstantial evidence the CBI has listed against the Talwars also included Rajesh's golf club, whose dimensions were found during forensic examination to be identical to the dimensions of the injuries on the heads of Aarushi and Hemraj. The golf club was claimed to have gone missing by Rajesh and when it was found a year later, it was "thoroughly cleaned" to remove all evidence.
The report also said Rajesh's brother, Dr Dinesh Talwar, had allegedly taken the help of a local, retired deputy superintendent of police, KK Gautam, to allegedly request for non-mention of rape in post-mortem proceedings and get Hemraj's body recovered. Dinesh even spoke to the doctor who conducted the autopsy, Dr Sunil Dohre, to influence him, the CBI has said.
On the night of the murders, the CBI says the Talwar's home was as usual; Aarushi was even gifted a camera by her parents in the evening.
The report rules out the involvement of the earlier suspects — Rajesh's medical assistant Krishna Thadarai and domestic helps Rajkumar Sharma and Vijay Mandal, who the CBI had arrested and put through scientific test"These allegations are so wild, so speculative, and so imaginative that means there are people in the CBI who are absolutely unscientific. I mean they don't even think like intelligent police officers. This is the state of the CBI?" Aarushi's mother Nupur Talwar told a news channel.
Aarushi was found murdered under mysterious circumstances in her parents' Jalvayu Vihar apartment in Noida May 16, 2008. The family's domestic help, Hemraj, was also found killed on the flat's terrace a day later.
The closure report said that the murder scene had been heavily "dressed up", which could only have been done by her parents.
It further stated that a bottle of Scotch whisky was found on the dining table. But according to the probe agency, any intruder would not have had sufficient time to consume liquor on the night of murder May 16, 2008.
Reacting to media reports that Rajesh Talwar was the only suspect in the double murder case, Nupur said: "If they had chargesheeted, I would have defended myself in the trial. But this is something they have purposely left hanging to us for the rest of our lives. You close the case, yet you are left with suspicions on you the rest of your life."
Nupur Talwar said both she and her husband were devastated by CBI's allegations, having to relive the days of 2008 repeatedly.
"Today, Rajesh is not able to sit here and talk to you, because he is completely broken and shattered," he said.
Lawyers representing Aarushi's parents are now waiting for Monday, when they expect the special court in Ghaziabad to take up the closure report. The parents are already planning to file a protest petition to fight the CBI's appeal to the court to close the case.
"Unless we see the complete closure report, it would be very premature to comment on any aspect of the case. If there are allegations against the Talwar couple, we will look into it. We will take up each and every aspect of the report point by point," counsel Rebecca John said.
She accused the CBI of "playing a game".
"There is absolutely no evidence against Dr. Talwar, which makes the CBI's allegations full of ambiguity," she added.
In 2008, Rajesh Talwar was arrested and kept behind bars for 50 days in connection with the killings, but was later let off because of lack of evidence. The CBI later arrested his medical assistant Krishna and two other domestic helps in the neighbourhood, Raj Kumar and Vijay Mandal.
The lawyer for the three employees Naresh Yadav said that if CBI had apprehension that the crime scene had been violated, then it should have registered a complaint.
"They (CBI) should have registered a case against the parents or the Noida police or the investigators if they found examples of tampering of evidence," he said.
Arushi Killing is the best example of how Media is ruling the country...Arushi case is nothing but entertaining murder mystery for everybody except her parents.
And in my opinion parents role is suspicious in this case and if they are involved then death of family member itself a big punishment for them. Its been better if culprit have been identified and punished ...
However It is a criminal case BUT it is not a national issue, all the hype is due to mystery (entertainment) part of the crime so it is getting media coverage and part of tea party gossip.😕
